1. These terms and conditions govern all bookings made with White Rock Holidays, a tour operator in India. By making a booking with us, you acknowledge and agree to abide by these terms and conditions. We strongly recommend that you carefully read and understand them prior to making a booking.
(a) Booking and Payment: To reserve a tour, you must accept the provided itinerary and submit the required booking amount. Please note that the deposit is non-refundable unless we, due to unforeseen circumstances, cancel the tour. The remaining balance of the tour price is due one day before the departure date. Failure to make timely payment may result in the cancellation of your booking, and your deposit will be retained.
(b) Cancellation & Refund Policy: We understand that cancellations may arise from extreme emergencies. However, managing cancellations involves significant costs, including administrative expenses, communication costs, and pre-purchased bills. Therefore, the following cancellation fees apply:
· Before 30 days: 25% of the tour cost
· Before 15 days: 50% of the tour cost
· Before 1 day 100% of the tour cost
(c) Please note that no refunds will be provided if a guest fails to join the tour, joins after the departure, or leaves before completion. The above cancellation fees are in addition to any fees imposed by accommodation providers, travel agents, third parties, or transport operators. Should you wish to cancel your booking, you must contact us for further clarification.
(d) Cancellation due to Natural Calamities/ Bad Weather/ Snow/ Landslides etc: In the event of tour cancellation or postponement due to natural calamities, landslides, snowfall, adverse weather conditions, road blockades, or similar circumstances beyond our control, no refund will be issued. If a particular location is affected and guests miss their stay at that location, the full cost of the hotel stay will be charged, along with the tariff of the hotel booked instantly for their emergency stay. In such cases, guests may choose to book and pay for emergency accommodation at their own expense. If a particular destination is canceled at the last moment, the full amount will be charged. While these situations are rare, they can occur, especially during winter months and the monsoon season, as nature and its elements are beyond our control.
(e) Changes by Us: We reserve the right to make changes to any aspect of the tour itinerary, including accommodation, transportation, activities, destinations, dates, and prices, due to factors beyond our control, such as weather conditions, natural disasters, political instability, health emergencies, or other unforeseen circumstances. We will promptly inform you of any significant changes and provide the following options:
Accepting the revised arrangements
Choosing an alternative tour of a similar standard and price (subject to availability)
Cancelling your booking and receiving a full refund
We cannot be held liable for any additional expenses or losses you may incur as a result of changes made by us.
(f) Changes by You: If you wish to modify your confirmed booking, such as changing travel dates, accommodation, or activities, you must notify us in writing as soon as possible. We will make every effort to accommodate your request, subject to availability and additional fees, if applicable. However, we cannot guarantee the implementation of the requested changes.
(g) Travel Documents and Insurance: It will be your responsibility to obtain all necessary travel documents, including passports, visas, health certificates, and vaccinations for yourself and any accompanying travellers. Adequate travel insurance, covering medical expenses, personal liability, cancellation fees, and repatriation costs in case of emergencies, is also mandatory. Proof of your insurance policy must be provided before departure.
(h) Your Responsibilities: During the tour, you are responsible for complying with all laws and regulations of the visited state. Respect for the customs, cultures, and environment of the local people and places is essential. You must behave courteously and respectfully toward fellow travellers, our staff members, service providers, and anyone else encountered during the tour. Engaging in any illegal, immoral, or harmful activities that may endanger yourself, others, or our reputation or property is strictly prohibited. We reserve the right to refuse service, terminate your participation, or take appropriate action if your conduct is deemed unacceptable or disruptive.
(j) Our Responsibilities: We are responsible for providing all services included in your tour package, as outlined in our contract with you. Please note that services not explicitly included, such as flights, transfers, meals, drinks, tips, personal expenses, or optional activities, are not our responsibility. We are not liable for any loss, damage, injury, illness, death, or inconvenience resulting from factors beyond our control, including weather conditions, natural disasters, political instability, health emergencies, war, terrorism, strikes, accidents, delays, cancellations, or errors or omissions by third parties.
(i) Complaints Procedure: If you have any complaints about our services during the tour, you must immediately inform our local representative or guide, allowing them an opportunity to resolve the issue on the spot. If the matter cannot be resolved satisfactorily, you must contact us via email or phone within 24 hours, enabling us to investigate further and take appropriate action. Failure to do so will release us from any liability or responsibility for your losses or inconvenience.
(l) Changes to Bookings: In the event of alterations to a booking, such as changes to the destination, date, or number of persons traveling, iC Kashmir Tours & Travels and our third-party tour operators reserve the right to charge applicable fees.
(m) Conditions of Travel: All guests must carry valid photo identification. International guests must have a passport, visa, and other necessary travel documents.
(n) We would not be responsible for the loss or damage to personal belongings or baggage.
(o) Child Policy: Children under 5 years old (1 child per room) will not incur any charges. Children aged above 5 years will be subject to charges. Please note that the child policy of hotels may vary, and specific information will be communicated during the booking process.
(p) Fitness Policy: Guests suffering from conditions such as asthma, heart diseases, or high altitude sickness must consult their doctors before visiting high altitude areas. If a guest experiences medical problems during the tour and is required to cancel their participation, the package cost will not be refunded.
